Digital Signature Forgery in Kuwait: Legal Framework and Penalties
As Kuwait moves toward full digital transformation, forging digital signatures is now treated as a criminal offense under the E-Transactions Law No. 20 of 2014. Digital signatures are legally equivalent to physical signatures when used in contracts, government documents, or financial transactions.
What Is Digital Signature Forgery?
- Creating or using a forged e-signature without consent.
- Altering the content of a signed digital document.
- Forging certificates issued by authorized certifying bodies.
Criminal Penalties
- Imprisonment up to 7 years for forgery involving public records or legal contracts.
- Fines up to KD 10,000.
- Revocation of business licenses or digital credentials.
Protection and Remedies
- Use certified e-signature systems with encryption.
- Report suspected forgery to the Cybercrime Unit or CA (Certification Authority).
- Initiate civil and criminal proceedings through legal representation.
