Cyber Defamation and Online Insults under Kuwaiti Law
Kuwait has enacted stringent laws to tackle online insults, slander, and defamation under Law No. 63 of 2015 on Cybercrime and the Penal Code. Any individual using digital platforms to harm another’s reputation may face criminal liability.
What is Cyber Defamation?
Cyber defamation includes publishing false or harmful statements online (social media, WhatsApp, forums, blogs) that damage a person’s dignity or reputation.
Examples of Violations
- Spreading personal photos or videos without consent.
- Accusing someone of a crime publicly on Instagram.
- Insulting religious beliefs or state figures online.
Legal Penalties
- Up to 3 years in prison and KD 3,000 in fines.
- Obligated removal of posts and public apology in some rulings.
- Repeat offenders may be banned from social media platforms by court order.
What You Should Do
- Screenshot and preserve all messages or posts.
- Report to Cybercrime Department (CID).
- Consult a lawyer to file a criminal complaint.
